Raped and impregnated by stepdad

An eight-year rape ordeal at the hands of her stepdad finally ended for a 20-year-old Phoenix woman when he was sentenced to 25 years in prison, leaving her with emotional scars and a child which he fathered.

According to Phoenix SAPS communications officer, Lt Louise Naidoo, the rape accused, 45-year-old Trennise Maistry, began his rape torture on the victim when she was nine-years-old in 2003. It is believed that the victim’s mother and Maistry lived together as a common law husband and wife over twenty years ago when the woman was pregnant with the victim.

It is alleged that as the rape continued, the victim was afraid to expose it to her mother or anyone else as Maistry had threatened her. The family is said to have moved from Phoenix to Pietermaritzburg and Pinetown and then back to Phoenix while the rape continued.

Lt Naidoo said, “While living on the Motala Farm in Pinetown, the victim fell pregnant and had a baby boy. The accused forced her to implicate her cousin as the father and he was arrested and charged for rape. The DNA test proved negative and the cousin was cleared of all charges. The rape accusations against the cousin caused a rift in the family and the accused, his wife and the victim and her baby, moved back to Phoenix. They found accommodation at a school where the accused worked as a cleaner.”

She added that in February 2011, the accused once again raped the victim while her mother was away on a visit. “When the victim threatened to tell her mother of the rape, the accused threatened to kill the victim’s mother and her baby in plain view of her. It is believed that three days after the rape, the victim went to visit her aunt and told her aunt of her rape ordeal. The matter was reported to the police and the accused was arrested on the same evening,” said Lt Naidoo.

The accused was granted bail and absconded to Pietermaritzburg when the matter was set for trial. It is reported that his exact location was unknown and a warrant of arrest was issued for him. After numerous unsuccessful attempts to locate Maistry, the investigating officer filed the case.

However, Det W/O Danny Pillay, was eager to track down the accused and in May this year, he re-opened the case. With the assistance of the SAP Tracking Unit in Durban, the accused was re-arrested in Pietermaritzburg, where he worked as a street vendor. A paternity test linked Maistry by DNA.

“A Victim Impact Statement was attained from the victim and the accused’s fate was sealed as the investigations by the I/O were complete. The accused was sentenced to 25 years imprisonment without parole,” said Lt Naidoo.

The Cluster Commander, Brig ML Ngobeni, commended the member for his excellent work in securing a 25 year sentence. Verulam Regional Court prosecutor, Ms K Ramsumujh placed on record Det W/O Pillay’s sterling efforts in investigating the case and added that he went above and beyond the call of duty to secure a conviction.
